Below you will find the Terms & Conditions of Smart People Global Academy.

These Terms & Conditions govern the use of the Smart People website and the provision of training services under Smart People Global Academy, including the rules for concluding sales contracts for Courses offered by Smart People sp. z o.o.

Course delivery takes place exclusively through the external Evol Campus Platform
Courses, Training paid training service (digital content) in the field of SAP SuccessFactors, provided by Smart People exclusively electronically through the educational platform, made available to the Customer after concluding the Agreement
Platform Evol Campus – an external educational platform to which Participants receive access (link, login, and password) after payment for the Course. Through the Evol Campus Platform, Courses are conducted, including live sessions, recordings, training materials, and communication with instructors. The Platform is a separate system from the smartpeople.com.pl website
Business means a natural person, legal person, or organizational unit without legal personality that is granted legal capacity by law, conducting business or professional activity in its own name and performing a legal action directly related to its business or professional activity
Consumer means a natural person performing a legal action with a business that is not directly related to their business or professional activity. For the purposes of these Terms & Conditions, the concept of Consumer also includes a natural person concluding an agreement directly related to their business activity, when it follows from the content of this agreement that it does not have a professional character for that person
Agreement Course sales agreement within the meaning of the Civil Code, concluded between Smart People and the Customer, concluded using the Website

1. General Provisions

1.1. These Terms & Conditions define the rules and conditions for using the Website, participating in Smart People Global Academy Courses, as well as your and our rights and obligations.

1.2. These Terms & Conditions are an integral part of the Agreement we conclude with you.

1.3. Content constituting works and contained on the Website, including the logo, name and graphic design of the website, as well as Courses (including training materials, session recordings, presentations) are legally protected and constitute the exclusive property of Smart People or another authorized entity. Without the consent of Smart People or another authorized entity, it is forbidden to copy, reproduce, and distribute in any way the content contained on the Website and materials from the Courses.

1.4. Use of the Website and participation in Courses is voluntary.

1.5. Before using the services or making a purchase through the Website, you have access to the Terms & Conditions and Privacy Policy – you should familiarize yourself with them carefully.

2. Technical Requirements

2.1. To use the Website and participate in Courses, you need:

  • an end device enabling access to the Internet (computer, laptop, tablet),
  • an active Internet connection with adequate bandwidth (recommended minimum 5 Mb/s for live sessions),
  • a current web browser enabling proper display of content and use of the Website and Platform functionality,
  • an active email address,
  • for participation in live sessions: microphone and optionally a webcam,
  • video conferencing software (details will be provided after purchasing the Course).

3. Types of Courses and Purchase

3.1. Courses for Individuals (B2C)

3.1.1. You can purchase Courses through the Website as an individual customer (Consumer).

3.1.2. Course prices for individuals are listed on the Website in euros (€) as net prices.

3.1.3. VAT is added to the net Course price according to the rate applicable in the Customer's country:

  • Customers from Poland: 23% VAT,
  • Consumers (individuals) from other EU countries: VAT according to the rate applicable in the Customer's country,
  • Businesses from the EU (outside Poland) with a valid EU VAT number: 0% VAT (reverse charge mechanism – the Business settles VAT in their own country),
  • Customers from outside the EU: 0% VAT (export of services).

3.1.4. The final amount to be paid (net price + VAT) is displayed in the order confirmation sent to the Customer's email address along with payment details.

3.1.5. Individuals not conducting business activity receive a proforma invoice and are required to make a 100% prepayment before the Course starts.

3.1.6. After the payment is posted, a VAT invoice is issued (if the Customer provided invoice details) or a fiscal receipt.

3.1.7. The current Course offer, their scope, and prices are available on the Website in the Smart People Global Academy section.

3.2. Courses for Companies (B2B)

3.2.1. Businesses can purchase Courses on individually agreed terms.

3.2.2. To obtain an offer for a company, please contact us by email at: [email protected] or through the form on the Website.

3.2.3. The terms of Course delivery for companies (including price, schedule, number of participants) are agreed individually and specified in a separate agreement or order confirmation.

4. Course Purchase Process (for Individuals)

4.1. To place an order for a Course, you should:

  1. select the appropriate Course on the Website in the Smart People Global Academy section,
  2. click the "Enroll" or "Buy Course" button,
  3. fill out the registration form providing all required data (first name, last name, email, phone, invoice data if required),
  4. accept these Terms & Conditions and Privacy Policy (by checking the appropriate checkboxes),
  5. consent to making the Course available before the expiration of 14 days and acknowledge the loss of the right to withdraw from the agreement after starting access to the Course (required checkbox),
  6. optionally: consent to receive marketing information,
  7. confirm the order by clicking the "Buy and Pay" button or another equivalent.

4.2. Confirming the order by the Customer means simultaneously:

  • submitting to us an offer to purchase the Course according to the choice made in the order form,
  • accepting the obligation to pay the Course price.

4.3. The Agreement is concluded when we accept the order for execution, which occurs by sending the Customer an email confirming the acceptance of the order along with payment details.

4.4. We are not responsible for failure to deliver order confirmation or delay resulting from the Customer providing incomplete, false, or incorrect data (in particular an incorrect email address).

4.5. We reserve the right to suspend order execution if the Customer provided false data or if the data raises justified doubts about its correctness. In such a case – if possible – we will attempt to contact the Customer to verify the data.

4.6. After correctly filling out the registration form, the Customer receives an automatic email confirming the acceptance of the order along with:

  • order confirmation and selected data,
  • payment details (bank account number, payment reference, amount to be paid),
  • payment deadline (usually 7 days from the registration date).

5. Financial Terms and Payments

5.1. Payment for the Course is made based on a VAT invoice or proforma invoice, by bank transfer to the indicated bank account.

5.2. Payment Rules

5.2.1. Individuals not conducting business activity are required to make a 100% prepayment based on a proforma invoice before the start of classes (before gaining access to the Platform).

5.2.2. Other entities (companies, businesses) receive a VAT invoice issued no later than 7 days before the Course starts, with a payment deadline of 7 days from the invoice date (unless otherwise agreed in the contract).

5.3. Currencies and Conversions

5.3.1. The applicable currency is:

  • PLN for domestic recipients (from Poland),
  • EUR for international recipients.

5.3.2. In case of prices quoted in foreign currencies, conversion is based on the average NBP (National Bank of Poland) exchange rate from the invoice date.

5.4. VAT Invoices

5.4.1. Smart People is authorized to issue VAT invoices without the recipient's signature.

5.4.2. With the Customer's consent, invoices may be sent exclusively in electronic form in accordance with applicable regulations. Consent may be withdrawn at any time.

5.4.3. VAT invoices are issued in electronic form (PDF) and sent to the Customer's email address specified in the order.

5.4.4. Invoices are issued after the payment is posted to Smart People's account.

5.5. Prices and VAT

5.5.1. Prices listed in the Smart People Global Academy offer are net prices, to which VAT is added in accordance with applicable regulations.

5.5.2. VAT is added to the Course price according to the rate applicable in the Customer's country:

  • Customers from Poland: 23% VAT (domestic rate),
  • Consumers (individuals) from other EU countries: VAT according to the rate applicable in the Customer's country,
  • Businesses from the EU (outside Poland) with a valid EU VAT number: 0% VAT (reverse charge mechanism – the Business settles VAT in their own country),
  • Customers from outside the EU: 0% VAT (export of services).

5.5.3. The final amount to be paid (net price + VAT, if applicable) is displayed in the order confirmation sent to the Customer's email address along with payment details.

5.5.4. In case of eligibility for VAT exemption, the Customer is required to provide an appropriate statement or document confirming the right to exemption.

5.6. Alternative Financing Forms

5.6.1. Smart People accepts other forms of Course financing, including:

  • training vouchers,
  • public funds (e.g., EU fund grants, employment office funding),
  • other forms indicated by the Customer.

5.6.2. Details of alternative financing forms are regulated by separate agreements or arrangements concluded individually with the Customer.

5.7. Available Payment Methods

5.7.1. The available payment method for individual Courses is traditional bank transfer.

5.7.2. After placing an order, the Customer receives at the provided email address:

  • order confirmation,
  • payment details (bank account number, payment reference, amount),
  • payment deadline (usually 7 days from the order date).

5.7.3. Payment should be made within the deadline specified in the order confirmation. Failure to pay on time may result in order cancellation.

6. Course Access

6.1. Access to the Course (Educational Platform) is granted to the Participant after the payment is posted to Smart People's bank account. In justified cases, access may be granted after receiving payment confirmation (e.g., screenshot from online banking).

6.2. After the payment is posted (or payment is confirmed), the Participant receives at the provided email address:

  • payment confirmation,
  • link to the Evol Campus educational platform,
  • login (usually the email address provided during registration),
  • temporary password (to be changed at first login),
  • login instructions and first steps on the Evol Campus Platform.

6.3. Access time: usually within 1-2 business days from payment posting.

6.4. Detailed information about the Course, including the live session schedule, training materials, participation rules, and communication with instructors, is available exclusively on the Evol Campus Platform after logging in. The smartpeople.com.pl website serves only for presenting the offer and Course registration.

6.5. In case of delay in granting access or login problems, the Participant should contact us by email: kontakt@smartpeople.com.pl

Important!

Starting Course access (logging into the Platform, browsing materials, participating in a live session) means loss of the right to withdraw from the agreement in accordance with Article 38(13) of the Consumer Rights Act.

7. Course Participation Rules

7.1. Live Sessions (Live Online Training)

7.1.1. Courses include training sessions conducted live via video conferencing platform.

7.1.2. The live session schedule (dates, times) is provided to the Participant after gaining Course access.

7.1.3. Participation in live sessions is recommended but not always mandatory – details depend on the specific Course and are specified in its description.

7.1.4. If unable to participate in a live session, the Participant has access to session recording (see point 7.2).

7.1.5. We reserve the right to change the live session schedule in justified cases (e.g., instructor illness, force majeure). Participants are informed of changes with adequate notice via email.

7.2. Live Session Recordings

7.2.1. All live sessions are recorded and made available to Course Participants on the Educational Platform.

7.2.2. Recordings are usually available within 24-48 hours after the live session ends.

7.2.3. Recordings are available to the Participant for the period specified in the Course description (usually minimum 12 months from the Course completion date).

7.2.4. Important: If the Participant turns on their camera or microphone during a live session, their image and/or voice may be recorded and available to other Course Participants. Participation in a live session with camera/microphone enabled means consent to such recording.

7.3. Training Materials

7.3.1. As part of the Course, Participants receive access to training materials, including:

  • presentations,
  • PDF documents,
  • practical exercises,
  • other supporting materials.

7.3.2. Materials are made available exclusively on the Educational Platform.

7.3.3. Some materials may be available for download, others only for online viewing – depending on the Course specifics.

7.4. Prohibition on Sharing Materials with Third Parties

7.4.1. Training materials, session recordings, and Platform access data are intended exclusively for the Participant who purchased the Course.

7.4.2. It is forbidden to:

  • share access data (login, password) with third parties,
  • copy, reproduce, distribute session recordings,
  • share training materials with third parties,
  • publish materials on the internet or other media,
  • use materials for commercial purposes without Smart People's consent.

7.4.3. Violation of the prohibition in point 7.4.2. may result in:

  • immediate blocking of Platform access,
  • termination of the Agreement with immediate effect without cost refund,
  • pursuing compensation claims.

7.5. Participant's Obligations

7.5.1. The Participant is obliged to:

  • use the Platform and Course in accordance with applicable law, the provisions of these Terms & Conditions, and good practices,
  • maintain culture and respect towards instructors and other Participants during live sessions,
  • refrain from actions that could disrupt the Platform's functioning or the course of live sessions,
  • secure their access data (login, password) from third-party access.

7.5.2. In case of violation by the Participant of the provisions of point 7.5.1., we may:

  • request the Participant to cease violations,
  • temporarily restrict Platform access,
  • exclude the Participant from further Course participation without cost refund,
  • take appropriate legal action.

7.6. Technical Support

7.6.1. In case of technical problems with Platform access or participation in live sessions, the Participant can contact us by email: [email protected]

7.6.2. We will make efforts to resolve technical problems as quickly as possible.

7.6.3. We are not responsible for technical problems on the Participant's side (e.g., lack of adequate internet connection, outdated browser, device problems).

8. Completion Certificate

8.1. After completing the Course, the Participant may receive a completion certificate issued by Smart People Global Academy.

8.2. Conditions for receiving the certificate:

  • Course completion (participation in the required number of sessions or access to required materials – details in Course description),
  • optionally: passing a final test or completing a final project (if the Course requires it).

8.3. The certificate is issued in electronic form (PDF) and sent to the Participant's email address.

8.4. The certificate confirms completion of training in SAP SuccessFactors conducted by Smart People Global Academy.

8.5. Note: The Smart People Global Academy certificate is not an official SAP certificate. It prepares for the SAP certification exam, which the Participant can take independently with an official SAP partner.

9. Right of Withdrawal from Agreement

9.1. If you are a Consumer and have concluded a distance contract through the Website, in accordance with Article 38(13) of the Consumer Rights Act of 30 May 2014, the right of withdrawal from the agreement does not apply to you with respect to agreements for the supply of digital content (Courses) not supplied on a tangible medium, for which you are obliged to pay the price, provided that:

  • you gained access to the purchased digital content (Course),
  • you consented to their provision before the expiration of the 14-day period for withdrawal from the agreement,
  • you were informed that after gaining access to the digital content (Course) you will lose the right to withdraw from the agreement and you acknowledged this.

Important!

By checking the checkbox in the registration form: "I consent to the course being made available before the expiration of 14 days and I acknowledge that after starting access to the course I will lose the right to withdraw from the agreement" – you meet the above conditions and lose the right to withdraw from the agreement upon gaining Platform access.

9.2. If we fail to meet any of the conditions in point 9.1. above, you have the right to withdraw from the Course purchase agreement within 14 days from the date of concluding the agreement.

9.3. To exercise the right of withdrawal from the agreement, you must inform us of your decision by means of a clear statement (e.g., letter sent by mail or email to: [email protected]).

9.4. In case of effective withdrawal from the agreement, we will refund all payments received from you immediately, and in any case no later than 14 days from the day we were informed of your decision to exercise the right of withdrawal from the agreement.

9.5. We will make the refund using the same payment methods that you used in the original transaction, unless you have expressly agreed to a different solution.

9.6. The above provisions regarding the right of withdrawal also apply when the party to the Course purchase agreement is a Business.

10. Complaints

10.1. You have the right to file a complaint regarding:

  • Website functioning,
  • Course purchase process,
  • quality of provided training services,
  • Platform access,
  • other matters related to Agreement execution.

10.2. You can file a complaint electronically at: [email protected]

10.3. The complaint should include:

  • data enabling identification and contact (first name, last name, email address),
  • indication of the Course or service the complaint concerns,
  • description of objections forming the basis of the complaint,
  • expected method of complaint resolution.

10.4. If the complaint does not contain information necessary for its consideration, we may ask you to supplement it within a specified deadline.

10.5. We process complaints without undue delay, no later than within 14 days from the day of their receipt.

10.6. We will inform you of the complaint resolution result electronically at the email address provided in the complaint.

10.7. Additionally, as a Consumer, you have the option to use out-of-court dispute resolution methods, including:

  • contacting the municipal or district consumer ombudsman,
  • filing a request with the Voivodeship Trade Inspection,
  • using the ODR platform (Online Dispute Resolution): http://ec.europa.eu/consumers/odr

10.8. Using out-of-court dispute resolution methods is voluntary and does not exclude the possibility of pursuing claims in court.

11. Liability

11.1. Smart People is responsible for proper execution of the Agreement in accordance with its provisions and applicable law.

11.2. Smart People is not responsible for:

  • technical problems on the Participant's side (lack of adequate internet connection, outdated browser, device failure),
  • failure to deliver emails resulting from providing an incorrect address or problems with the Participant's mail server,
  • inability to participate in live sessions due to reasons on the Participant's side,
  • actions of third parties to whom the Participant provided Platform access data contrary to these Terms & Conditions.

11.3. Smart People will make efforts for the Platform to operate continuously and without disruptions, however, does not guarantee one hundred percent availability due to the possibility of technical breaks, maintenance, or problems on the side of internet service providers.

11.4. In case of technical breaks on Smart People's side exceeding 24 hours, Participants will be informed about this by email along with information about the planned access restoration time.

11.5. Smart People's liability towards Businesses is limited to the amount of the price paid for the Course, unless the damage was caused intentionally.

12. Intellectual Property

12.1. All copyrights and intellectual property rights to Courses, training materials, session recordings, presentations, and content contained on the Website and Platform belong to Smart People or other authorized entities.

12.2. Purchasing a Course does not mean transfer of copyrights or granting a license to use materials for commercial purposes.

12.3. The Participant acquires the right to use materials exclusively for their own educational use to the extent necessary to complete the Course.

13. Changes to Terms & Conditions

13.1. We may change these Terms & Conditions, especially if the scope of our services or legal regulations changes.

13.2. Customers will be informed of each change electronically (email) or through clear information displayed on the Website, with at least 14 days advance notice before the changes take effect.

13.3. Changes to the Terms & Conditions do not affect orders placed before their effective date.

13.4. Agreements concluded before the Terms & Conditions change are subject to the version of the Terms & Conditions in effect at the time of placing the order.

13.5. If you do not agree with the introduced changes, you may discontinue using the services or not make subsequent purchases before they take effect.

14. Electronic Services Provided Through the Website

14.1. Through the smartpeople.com.pl Website, we provide Customers with the following electronic services:

  • enabling browsing of Website content, including information about Smart People Global Academy Course offers,
  • enabling placing orders for Course purchases through the registration form,
  • enabling communication with us through the contact form.

14.2. Electronic services referred to in point 14.1. are provided free of charge, for an indefinite period or one-time.

14.3. Important: Course delivery (including live sessions, recordings, training materials, communication with instructors) takes place exclusively through the external Evol Campus Platform, to which the Participant receives access after payment. The smartpeople.com.pl website serves only for presenting the offer and Course registration.

14.4. Access to Courses delivered on the Evol Campus Platform is paid and provided in accordance with the conditions specified in these Terms & Conditions.

15. Final Provisions

15.1. We are a company operating in Poland, therefore the law applicable to the provision of services and execution of the Agreement is the law of the Republic of Poland.

15.2. In the case of a Customer who is a Business, any court disputes are resolved by the court with jurisdiction over Smart People's registered office.

15.3. In the case of a Customer who is a Consumer, disputes may be resolved by the competent court according to the provisions of the Code of Civil Procedure.

15.4. Matters not regulated in the Terms & Conditions are governed by the provisions of:

  • Civil Code,
  • Consumer Rights Act,
  • Act on
